PRC Rulemaking laws
For all its rulemakings the Commission follows the provisions of the State Rules Act, § 14-4-1 et seq. NMSA 1978, and the rulemaking provisions in the Public Regulation Commission Act, § 62-19-21 NMSA 1978. These statutes contains requirements for public notice content, pre-hearing notice timing, and notice publication methods, among other requirements.
- For Public Utility Act rulemakings, the Commission follows Rulemaking Procedures, 17.1.120 NMAC. This rule sets out the requirements of pre-action notice publication timing and notice content, and provides other specific requirements of procedure.
- For all other rulemakings the Commission follows the Attorney General’s Default Procedural Rule for Rulemaking, 1.24.25 NMAC.
- In addition, the Commission follows the guidance in the State Records Administrator’s rulemaking rules New Mexico Administrative Code (NMAC), 1.24.10 NMAC and New Mexico Register, 1.24.15 NMAC.
Rulemaking Records
For all rulemaking proceedings, the “Rulemaking Record,” as defined by the New Mexico State Rules Act, is made up of various documents, pleadings, comments, and other information that is readily available through this website. To view the Rulemaking Record for any of the rulemakings listed below, access the Commission’s “Edocket” using the link and guest login information above. Once you are logged in to Edocket, enter the case number in the “Case # Search” field at the top center of the screen and click enter. Click on the case number on the following screen and then the “Case Documents” tab in the upper left corner. The next screen will show you all of the documents filed in the rulemaking proceeding, i.e. the Rulemaking Record, in chronological order. Click on the name of any document and then click on the name again on the following screen to download a PDF version.
